Terms of Service

These Terms of Service ("Terms") govern your use of the website builder and hosting service operated at dmsitebuilder.com (the "Service") by DM Site Builder ("we", "us", "our"). By creating an account, paying for a subscription, or downloading a generated website, you agree to be bound by these Terms.

1. What we provide

The Service lets you build a single-page website for a taxi, private-hire, airport-transfer, or chauffeur business and either (a) download it as a static HTML file to host yourself, or (b) pay a subscription for us to host it on a subdomain of dmsb.uk with SSL, an enquiry-forwarding form, and inline-edit tools.

2. Your responsibilities — licences, insurance, compliance

We are a website tool. We are not your regulator, not your operator, and not responsible for whether you are legally allowed to take bookings. You alone are responsible for:

• Holding any private-hire / hackney-carriage operator's licence, vehicle licence, and driver licence required by the local licensing authority for the area you operate in.
• Carrying valid hire-and-reward motor insurance, public liability insurance, and any other cover required by your insurer or licensing authority.
• Ensuring drivers are DBS-checked, medically fit, and meet your authority's knowledge / driving-standard requirements.
• Registering with the Information Commissioner's Office (ICO) if you process customer personal data (almost all operators must).
• Complying with the Equality Act 2010, the Taxis and Private Hire Vehicles (Disabled Persons) Act 2022, and all other applicable legislation.
• The accuracy of every piece of content displayed on your website, including pricing, service area, contact details, and review quotes.

If you take bookings via your site without the necessary licences or insurance, that is a matter between you and your licensing authority. We take no part in it and accept no liability for it.

3. Subscription, billing, cancellation

• Paid plans renew automatically (monthly or annually) until cancelled. Cancel any time from your dashboard or by messaging us on WhatsApp — your site stays live until the end of your paid period.
• We may change prices with at least 30 days' notice; existing subscribers keep their current price until the next renewal.
• Refunds are offered at our discretion. We typically pro-rate annual plans within the first 14 days; outside that we do not refund unused months unless the Service has failed.

4. Acceptable use

You agree not to use the Service to:

• Take bookings you are not legally licensed to provide.
• Mislead customers about your fares, services, or qualifications.
• Impersonate another business or individual.
• Host illegal content, malware, or anything that violates UK law.
• Attempt to interfere with the Service, other users' sites, or our systems.

We may suspend or terminate your account at any time, with or without notice, if you breach these terms or use the Service in a way that exposes us or our other users to legal or reputational risk.

5. Enquiries forwarded from your site

Submissions from your site's contact form are forwarded to your email address. We do not store the message content beyond the time required to deliver it. We do not vet, mediate, or take responsibility for any booking, dispute, payment, or interaction between you and any customer who contacts you through your site.

6. Intellectual property

You own everything you write, upload, or supply (business name, copy, reviews, photos). You grant us a non-exclusive licence to host and display that content as part of running the Service. We own the templates, the builder tool, and the platform code.

7. Service availability

We aim for high availability but make no specific uptime guarantee. We may take the Service offline for maintenance with reasonable notice. We are not liable for losses caused by outages, including missed bookings.

8. Limitation of liability

To the maximum extent permitted by law:

• The Service is provided "as is". We make no warranties about fitness for purpose, accuracy of generated content, or uninterrupted availability.
• Our total liability to you for any claim arising out of or in connection with these Terms is limited to the amount you paid us in the twelve months preceding the claim.
• We are not liable for indirect or consequential losses, lost profits, lost bookings, lost data, or reputational harm.
• Nothing in these Terms excludes liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be excluded.

9. Indemnity

You agree to indemnify and hold us harmless from any claim, fine, or cost (including legal fees) arising out of (a) your operation of a taxi / private-hire / chauffeur business, (b) any failure to hold the proper licences or insurance, (c) any content you publish on your site, or (d) any breach of these Terms.

10. Changes to these Terms

We may update these Terms from time to time. Material changes will be notified on dmsitebuilder.com or via the contact details on your account. Continued use of the Service after a change means you accept the new Terms.

11. Governing law

These Terms are governed by the laws of England and Wales. Any dispute is subject to the exclusive jurisdiction of the courts of England and Wales.
